Yet according t the Parliamentary report[15] autistic unemployment is the highest of all disability groups, stagnating at 77% for decades while the rate of progress is slowing down. The two rounds of Autism Strategy since the Autism Act 2010 and government efforts to reduce the disability employment gap didn\u2019t\u2019 make an impact on the employment for autistic people. <\/p><p><\/p>\n                \n                \n                \n                <p>Positive autism identity, being employed, autism acceptance and recognition of the role of autistic people in society are significant factors of autistic wellbeing and quality of life [1, 2, 3, 4].<sup>.<\/sup> Being employed encapsulates all these important factors.<\/p>\n                \n                \n                \n                <p>Autistic unemployment is highest of all disability groups, stagnating for over a decade. Only 16% of autistic people are in full time employment while 77% are unemployed and want to work, 58% among them want some help getting into employment, but don\u2019t get any [5].<\/p>\n                \n                \n                \n                <p>According to the NAS, \u2018The UK Government\n                promised to halve the disability employment gap by the end of this Parliament,\n                meaning they have to increase the disability employment rate from 47% to 64%.\n                So, to make sure that autistic people aren\u2019t left behind, the Government needs\n                to commit to doubling the number of autistic people in work [6].\u2019 <\/p>\n                \n                \n                \n                <p>The government has recently committed to monitor autism employment gap, which is a significant first step<a> [8]<\/a>.<\/p>\n                \n                \n                \n                <p>The general disability employment gap has not changed in last decade and is as high as 30%, according to Scope [9]. Government drive to reduce the employment gap did not make an impact for autistic people.<\/p>\n                \n                \n                \n                <p>NAS survey found that \u2018when we\n                asked about the single biggest thing that needed to change to help autistic\n                people get into work, over 50% said support, understanding or acceptance. <\/p>\n                \n                \n                \n                <p>60% of employers NAS polled told that they are worried about getting support wrong and they don\u2019t know where to go to get information about supporting autistic employees [8].<\/p>\n                \n                \n                \n                <p>Please note all of our course materials, videos and webinars are provided for general information only. Their contents do not represent legal advice.&nbsp; Their content represents original work and are protected by copyrights and are intellectual property of NDSA Partnership C.I.C.<\/p>\n                \n                \n            <\/div>\n          <\/div>\n\n          <!-- part 2 -->\n          <hr>\n          <a name=\"lex\" id=\"lex\"><\/a>\n          <div class=\"container lex\">\n            <div class=\"label\">\n              <span class=\"button-toggle\"><\/span>Lived experiences\n            <\/div>\n            <div class=\"content\">\n              <p>Experiences of autistic people in\n                employment are surprisingly similar.<\/p>\n                \n                \n                \n                <p>Managerial attitudes and\n                prejudices to autism in society, discriminatory HR provisions, criteria and\n                practices, as well as pervasive bullying are the key barriers autistic people\n                experience. <\/p>\n                \n                \n                \n                <p>Often autistic people report not\n                being taken seriously and listened to after disclosure. <\/p>\n                \n                \n                \n                <p>Research highlighted subconscious\n                unfavourable attitudes to autistic people in \u2018blind\u2019 observation tests [10],\n                which might underpin some of the bullying. However, the causal relationships\n                and mechanisms of these unfavourable attitudes require further research. <\/p>\n                \n                \n                \n                <p>Autistic researcher Brett Heasman\n                uncovered a similar understanding and attitude gap due to common stereotypes\n                about autism even within family relationships: \u201cPerspective taking is two\n                sided\u201d <\/p>\n                \n                \n                \n                <p>This and other studies provide\n                evidence for to the Double Empathy problem theory that proposes that the\n                understanding gap is two sided [12, 13].<\/p>\n                \n                \n                \n                <p>Nevertheless, in terms of\n                experience in employment, &nbsp;some people\n                report positive experience with Access To Work. [link to Train Spotter}<\/p>\n                \n                \n                \n                <p>Disclosure is often a tricky time\n                and more often than not triggers the managerial and HR machinery that may\n                result in pushing the autistic employee out<\/p>\n            <\/div>\n          <\/div>\n\n          <!-- part 3 -->\n          <hr>\n          <a name=\"eac\" id=\"eac\"><\/a>\n          <div class=\"container eac\">\n            <div class=\"label\">\n              <span class=\"button-toggle\"><\/span>Equality Act\n            <\/div>\n            <div class=\"content\">\n              <p>Please note all of our materials, videos and webinars are provided for general information only. Their contents do not represent legal advice.&nbsp; Their content represents original work and are protected by copyrights and are intellectual property of NDSA Partnership C.I.C.<\/p>\n\n\n\n              <p>The Equality Act 2010 [link to <a href=\"https:\/\/www.equalityhumanrights.com\/en\/equality-act\/equality-act-2010\">https:\/\/www.equalityhumanrights.com\/en\/equality-act\/equality-act-2010<\/a>] &nbsp;protects people from discrimination in the workplace and in wider society. <\/p>\n              \n              \n              \n              <p>It is against the law to treat\n              any person unfairly or less favourably because of a <strong>\u2018protected\n              characteristic\u2019<\/strong> such as a <strong>disability<\/strong>. <\/p>\n              \n              \n              \n              <p>ACAS and other organisations\n              provide good guidance on legal aspects in employment.<\/p>\n              \n              \n              \n              <p><a href=\"https:\/\/www.acas.org.uk\/disability\">https:\/\/www.acas.org.uk\/disability<\/a><\/p>\n              \n              \n              \n              <p>The Act also puts a duty on\n              employers to make <strong>reasonable adjustments<\/strong> and a <strong>Disability Equality\n              Duty<\/strong> on public service employers to take proactive reasonable steps to\n              treat disabled employees equally.<\/p>\n              \n              \n              \n              <p>The Act protects people at all stages\n              of employment, including recruitment, employment terms and conditions,\n              training, pay and benefits, promotion and transfer opportunities, dismissal or\n              redundancy [14].<\/p>\n              \n              \n              \n              <p>You must be able to prove that\n              your condition is a <strong>disability<\/strong> and that with or without reasonable\n              adjustments you are <strong>qualified<\/strong> for the essential duties of the job.<\/p>\n              \n              \n              \n              <p>In general terms the Act protects\n              a qualified employee from being treated <strong>less favourably<\/strong><\/p>\n              \n              \n              \n              <ul><li>For the reason of disability \u2013 just because they\n              are disabled, this is <strong>direct discrimination,<\/strong><ul><li>including discrimination <strong>&nbsp;by association<\/strong> with a disabled person;<\/li><\/ul><ul><li>due to <strong>perceived disability.<\/strong><\/li><\/ul><\/li><li>For the reason <strong>arising from disability<\/strong> \u2013 for\n              example when people have prejudices against a disability and treat less\n              favourable because of that, rather than because of specific circumstances of\n              the individual<\/li><li>By indirectly by applying a <strong>criterion,\n              provision or practice<\/strong> that applies to everyone, but puts a disabled person\n              at a disadvantage that <strong>could not be justified<\/strong>;<\/li><li>By failing to make <strong>reasonable adjustments<\/strong>\n              to mitigate the disadvantage.<\/li><li>By<strong> victimisation<\/strong> <\/li><li><strong>Harassment&nbsp;\n              <\/strong><\/li><\/ul>\n              \n              \n              \n              <p>Specific application of the equality\n              act is intricate and based on an individual case. <\/p>\n              \n              \n              \n              <p>See ACAS, &nbsp;Equality and Human Rights Commission guidance\n              and archives of Equal Opportunity Commission (EOC).<\/p>\n              \n              \n              \n              <p><a href=\"https:\/\/www.acas.org.uk\/disability\">https:\/\/www.acas.org.uk\/disability<\/a><\/p>\n              \n              \n              \n              <p><a href=\"https:\/\/www.equalityhumanrights.com\/en\/equality-act\/equality-act-2010\">https:\/\/www.equalityhumanrights.com\/en\/equality-act\/equality-act-2010<\/a><\/p>\n              \n              \n              \n              <figure class=\"wp-block-embed-wordpress wp-block-embed is-type-wp-embed is-provider-eoc\" width=\"auto\"><div class=\"wp-block-embed__wrapper\">\n              <blockquote class=\"wp-embedded-content\" data-secret=\"3vm90jo0NZ\"><a href=\"https:\/\/www.eoc.org.uk\/the-equality-act\/\">The Equality Act<\/a><\/blockquote><iframe class=\"wp-embedded-content\" sandbox=\"allow-scripts\" security=\"restricted\" style=\"position: absolute; Their contents do not represent legal advice.&nbsp; Their content represents original work and are protected by copyrights and are intellectual property of NDSA Partnership C.I.C.<\/p>\n\n\n\n<p>Understanding the Equality Act is crucial for a successful disclosure.<\/p>\n\n\n\n<p>Often people assume that their\nemployment is protected by the Act and the disclosure will trigger a range of\npositive changes, and some people do.<\/p>\n\n\n\n<p>Unfortunately, in practice it is\nnot always the case due to a range of factors that can relate to\ndiscrimination, but also due to the specific circumstances of the disclosure. Understanding\nwhat the Act does and doesn\u2019t say is crucial.<\/p>\n\n\n\n<p>You should be qualified for the\njob to be protected. The Act protects employees whose disability does not\nprevent them from performing essential aspects of their job. <\/p>\n\n\n\n<p>The definition of disability in\nthe Equality Act is doing things differently or requiring longer time.<\/p>\n\n\n\n<p>So for disclosure <strong>it is important to articulate why and how autism doesn\u2019t prevent you from performing the role and achieving results, but requires Reasonable Adjustment<\/strong> to accommodate the different way or longer time you may require due to a disability.<\/p>\n\n            <\/div>\n          <\/div>\n\n          <!-- part 5 -->\n          <hr>\n          <a name=\"dod\" id=\"dod\"><\/a>\n          <div class=\"container dod\">\n            <div class=\"label\">\n              <span class=\"button-toggle\"><\/span>Definition of disability\n            <\/div>\n            <div class=\"content\">\n              <p>You\u2019re disabled under the\n                Equality Act 2010 if you have a physical or mental impairment that has a \u2018<strong>substantial\u2019<\/strong>\n                and \u2018<strong>long-term<\/strong>\u2019 negative effect on your ability to do <strong>normal day to\n                day activities<\/strong>.<\/p>\n                \n                \n                \n                <p>Communication is a normal day to\n                day activity<\/p>\n                \n                \n                \n                <p>\u2018Substantial\u2019 is more than minor\n                or trivial, eg you do it in a different way or it takes much longer than it\n                usually would to complete a daily task \u2026<\/p>\n                \n                \n                \n                <p>\u2018Long-term\u2019 means 12 months or\n                more, e.g, a breathing condition that develops as a result of a lung infection<\/p>\n                \n                \n                \n                <p>Source: <a href=\"https:\/\/www.gov.uk\/definition-of-disability-under-equality-act-2010\">https:\/\/www.gov.uk\/definition-of-disability-under-equality-act-2010<\/a><\/p>\n                \n                \n                \n                <p><\/p>\n                \n            <\/div>\n          <\/div>\n\n          <!-- part 6 -->\n          <hr>\n          <a name=\"aaa\" id=\"aaa\"><\/a>\n          <div class=\"container aaa\">\n            <div class=\"label\">\n              <span class=\"button-toggle\"><\/span>Autism as a disability\n            <\/div>\n            <div class=\"content\">\n              <h2>Is autism a disability?<\/h2>\n\n\n\n              <p>While individuals may not always reach the threshold in the ESA and PIP assessment, under the Equality Act and in particular under the framework of the social model of disability, it most often is. So it can be disclosed as a disability in diversity monitoring forms and in other circumstances covered by the Equality Act, like in employment and usage of services. <br><br><br>The government stance is clear that autism is a disability (as accessed on May 2020):<br><a href=\"https:\/\/publicappointments.cabinetoffice.gov.uk\/recording-whether-or-not-you-have-a-disability\/\">https:\/\/publicappointments.cabinetoffice.gov.uk\/recording-whether-or-not-you-have-a-disability\/<\/a><br><\/p>\n              \n              \n              \n              <p><\/p>\n              \n              \n              \n              <p>\u201cWe ask all applicants to public appointments to complete a diversity monitoring form, which includes questions about disability. We hope you will help us by providing this information. This will allow us to see if there are any unfair barriers to becoming a public appointee and whether there are any changes we could make to encourage disabled candidates to apply<\/p>\n              \n              \n              \n              <p>To help you, please consider the following list of conditions. They are also not treating the disabled employee \u2018more favourably\u2019 but mitigating the disadvantage of the disability to enable a level playing field for disabled people. <\/p>\n              \n              \n              \n              <p>What is reasonable to a particular role is subject to interpretation and it is indeed important to be able to articulate how one is qualified for the role (see the section o disclosure above) with the implementation of reasonable adjustments.<\/p>\n              \n              \n              \n              <p>Employers only have to make reasonable adjustments if they are aware or reasonably expected to be aware that the employee has a disability.<\/p>\n              \n              \n              \n              <p>The definition of what is reasonable is left to be tested in each individual case and could be a source of disagreement between the employer and the employee. This could bee a case of inconsistent implementation of the Equality Act.
